00:04corporate America and big Tech is trying
00:06to speedrun its way into absolutely
00:08pissing off its entire customer base now
00:11if you're somebody that produces content
00:13on the internet like me or you're
00:14somebody that likes to dabble and
00:16creating you know videos maybe like to
00:18photoshop things you probably know of a
00:20company known as Adobe okay it's been
00:22around for a long time in fact you don't
00:24have to be a content creator to use it
00:26are you sitting in a hospital or
00:27something and probably looking through
00:29PDFs you might be the Boomer that's
00:31still running Adobe Acrobat okay or your
00:34organization might still be using Adobe
00:37products now Adobe released this little
00:39Ping On most people's creative clouds
00:42that pretty much scared people
00:43immediately when they saw it updated
00:46terms of use we made some changes to
00:48adobe's General to regarding the use of
00:51software clarified that we may access
00:54your content through both automated and
00:56manual methods such as for Content
01:02no ladies and gentlemen immediately upon
01:04reading that people started to wonder
01:06whoa how do I quickly cancel my
01:08subscription I don't want this company
01:10looking through my stuff that's weird
01:13now if you don't know adobe's been kind
01:14of pushing this AI craze lately and I'm
01:17just going to say it like it is I think
01:19artificial intelligence and user privacy
01:21are like two two things that can never
01:24meet okay as long as these big companies
01:26keep pushing into making artificial
01:28intelligence a thing they're going to
01:30need training data okay meaning data
01:33that they use to basically train these
01:35AIS into producing the weird gobbly go
01:38the photos the videos the music that
01:40they end up producing that training data
01:43people are fearing is actually coming
01:44from their own projects okay their own
01:47products so obviously that's a big no no
01:50and it might even be illegal depending
01:52on where you live but honestly for big
01:54companies it's about making $5 billion
01:57and then paying a $5 million fine
02:022033 and and handwashing all of your
02:04sins away that's just unfortunately how
02:07things work now Do's kind of been
02:09running the entire uh PR campaign for
02:12the last two days trying to make sure
02:14that people understand who who hold on
02:16there buddies this is this isn't we're
02:19not trying to be we're not trying to be
02:20those [ __ ] stealing your stuff so
02:23they talk about we recently made an
02:24update to our terms of service with a
02:26goal of providing more clarity on a few
02:29specific areas and pushed a routine
02:31reaccept of those terms to Adobe
02:33Creative Cloud and document customers so
02:36what's different the focus on this
02:37update was to be clear about the
02:39improvements to our moderation processes
02:41that we've given in place given the
02:43explosion of generative Ai and our
02:45commitment to responsible Innovation
02:48okay they've also added human moderation
02:50to the content submissions review
02:52processes so they give an idea of what
02:54exactly was updated in this situation so
02:56they bring up section two and section 4
02:59we're going to read this a little closer
03:00ourselves to be clear Adobe requires a
03:03limited license to access content solely
03:06for the purpose of operating or
03:08improving these services and software
03:11and to enforce our terms to comply with
03:13the law such as to protect against
03:15abusive content so okay the abusive
03:18content part makes a little bit of sense
03:20anytime you go to a cloud service
03:22provider and you upload content like
03:23photos they will periodically check
03:26hashes on files to make sure things
03:29don't match up with known cam hash files
03:32okay we've talked about this extensively
03:34before on my channel but uh that's kind
03:37of what they're going with Adobe does
03:38this Google does this apple will do this
03:41tons of cloud providers will do this and
03:44I necessarily don't have an issue with
03:46them making sure that cam content
03:48doesn't exist on their servers but that
03:50is totally different from the first
03:52[ __ ] sentence that we are talking
03:54about here which we'll delve into so
03:57they say that access is needed for Adobe
03:59applications and services to perform the
04:02functions they are designed and used for
04:04such as opening and editing files for
04:06the user or creating thumbnails or a
04:08preview for sharing oh yeah is that it
04:11you know that's such a broad sentence
04:14that legally you could probably use it
04:16to improve other parts of your software
04:18like generative AI okay it kind of feels
04:21vague enough for it doesn't it Adobe
04:23access is needed to deliver some of our
04:25most Innovative cloud-based features
04:27such as Photoshop neural filters liquid
04:30mode or remove background you can read
04:32more including how users can control how
04:35their content may be accessed for
04:37Content processed or stored on Adobe
04:39servers Adobe may use Technologies and
04:42other processes including escalation for
04:44human review so when they're checking
04:46for that cam Behavior now they do say
04:48that nothing in their generative AI
04:50model is trained on consumer content
04:53which is basically we have to take their
04:55[ __ ] word for it you can read their
04:57FAQ when they actually talk about where
04:59this content is coming from so they
05:01actually say the content comes from a
05:03data set of licens content such as Adobe
05:05stock and public domain content and
05:08they're going to find new avenues for I
05:10guess ethically sourced training data so
05:13where I want to look into is the [ __ ]
05:15legal board for this okay because I
05:17really do not trust any of these
05:19companies this is adobe.com legal terms.
05:23HTML and again I'm going to refresh the
05:26page just so people know that I'm not
05:27bullshitting around and that this is not
05:30you know some like this is literally not
05:32edited okay in any capacity so this is
05:35published February 17th effective as of
05:392024 so the version of what people are
05:41kind of freaked out about is right here
05:43four so 4.2 which is licenses to your
05:47content okay so right here they write
05:50solely for the purposes of operating or
05:52improving the services and software and
05:56again that can be so vague okay what do
05:58you mean improving the services and
06:00software your software is implementing
06:03AI across the board Photoshop After
06:06Effects uh you know [ __ ] like Premiere
06:08Pro anything that you say improves a
06:11software it could be anything that is
06:13such a vague term it could lit I mean if
06:15you use my IP to Market your product to
06:19improve your services and software I
06:21don't know the vagueness is a thing
06:23people are calling out and there are
06:24legal firms that sit down and wonder
06:26maybe we need to reconsider our you know
06:28relation with Adobe uh if they don't
06:30have some VIP clause or like an
06:32Enterprise level situation already you
06:36grant us a nonexclusive
06:38worldwide royaltyfree sub license licens
06:42to use reproduce publicly display
06:46distribute modify create derivative
06:49Works based on publicly perform and
06:52translate the content okay so you're
06:53granting them all of that okay all of
06:56that stuff when you deal with your
06:59content and remember content means any
07:00text information communication such as
07:03audio files video files electronic
07:06documents so imagine uploading like an
07:09NDA written document okay and it gets
07:11scanned by their their cloud service
07:13okay are you not violating an NDA by
07:16possibly doing that in some way it's
07:18such a confusing mindfield or images
07:20that you upload import to embed or use
07:24uh sorry embed for use by or create
07:26using the services and software we
07:28reserve the right to remove content or
07:31restrict access to content services and
07:33software if any of your content is found
07:35to be in violation of the terms and I
07:37think that has more to do with illegal
07:39CA material but this is what they mean
07:42by any content they have basically
07:43covered anything that you're
07:45uploading so right here going back to
07:494.2 in specific right where they may uh
07:52for example we may sulic our right to
07:54the content to our service providers or
07:57to other users to allow the service and
07:59software to operate as intended such as
08:02enabling you to share photos with others
08:04separately section 4.6 below covers any
08:07feedback that you provide to us so
08:09what's interesting about this is it
08:10already feels vague right like we talked
08:12about this first sentence where your
08:14content solely for the purposes of
08:16operating or improving their software
08:18and services could that not include your
08:21AI Services could that not include your
08:23generative stuff okay that is so vague
08:25that even if you were to take these
08:27people to court this might give Adobe
08:29enough legal water to stand tall and say
08:31we literally are just using the stuff to
08:33improve our software and services and
08:36again when they talk about things like
08:38you know uh for example uh subl
08:41licensing the right to the content for
08:43the service providers or to other users
08:44to allow the services and software to
08:47operate as intended such as then
08:49allowing you to share it with other
08:50people it's like they use the most
08:52harmless example for the most vague
08:54Clauses imaginable and that's literally
08:57the only thing that people have been
08:58having a serious issue with okay two
09:01days ago this started popping up people
09:03got a little pop up they started to see
09:05this and for Adobe they've talked about
09:07this situation not being that new okay
09:10so when this user on the internet Sasha
09:12yansin called this out for instance this
09:14exact section uh one of the users uh the
09:17strategy product design author at Adobe
09:20talked about every cloud service
09:21requires a license solely for the
09:23purpose of operating that's been over
09:25there for a decade but our summary
09:27language didn't clarify so they posted
09:29that clarification which we read and
09:31again this person says I give zero shits
09:34about the Adobe clarifications or blog
09:36posts you force people to sign new terms
09:38legally they are the only thing that
09:40actually matter and that's true blogs
09:42don't matter your legal print is the
09:45only thing that matters that's always
09:46signed with okay so then they say Hey
09:49listen the typical the for the sole
09:51purpose of operating license that every
09:53cloud company requires to function host
09:55and modify content for certain features
09:57has been there for 11 years but like
10:00what's interesting about this is this
10:01guy they've never written anywhere in
10:03this legal text that okay for all these
10:05Services your content is going to be
10:07used to improve the services and
10:09software but nowhere is it going to be
10:11prevented from being used in their
10:13generative AI you might be like well
10:15muda what if this is just for people who
10:16are operating within the uh you know uh
10:19Creative Cloud their their online
10:21hosting service So for anybody that
10:23doesn't know when you purchase a
10:25subscription to Adobe software you get
10:27access to like 100 GB of online storage
10:30space and this is the thing if you ask
10:32me personally I think if you expect
10:34privacy from an online storage provider
10:36never expect that even though I think
10:38personally if you're paying for storage
10:40you should be allowed to store what you
10:42want with a reasonable expectation of
10:44privacy I kind of compare this to like
10:46public storage places where you rent a
10:48place out in the real world you you know
10:50you drop [ __ ] in there and provided it's
10:52not readily apparent that that place is
10:54being used for illegal purposes like
10:56operating a meth lab or something like
10:58that you should be under reasonable
11:00understanding that nobody is going to
11:01open up your door out of nowhere and
11:03just look through your stuff if people
11:05figured that was going to be happening
11:06at a big storage facility I would
11:09probably wager that 99% of the people
11:11renting there probably would choose to
11:13cancel their [ __ ] subscriptions if
11:15they found out that is what could
11:17possibly happen and that's what you're
11:18legally giving them allowance to and
11:21that's one of the things that goes into
11:23my head it's one of the reasons why even
11:25for me right here we have our own actual
11:28personal cloud storage so I have a
11:30server in the basement that we just
11:31upload stuff to and you can access it
11:33from anywhere in the world when I got to
11:35send anybody a file I just upload it to
11:37a server in the basement I give them a
11:39little uh you know share link they
11:40download it to their computer and call
11:42it a day but honestly I I feel like
11:45that's just you know not many people are
11:47a going to be doing that or have the
11:49understanding to set up their own cloud
11:50providers but yeah this is one of the
11:52things where it's like if you have if
11:54you're paying for anything an adobe sign
11:57it's not like they're giving you the
11:58stuff for free so then to add extra
12:01stuff onto this legal text is just an
12:03insult to injury and it's got people
12:05really actually discussing this
12:07situation look Adobe has competition
12:10okay they do you know at this moment in
12:12time reading through some of the stuff
12:14and realizing how much we pay for Adobe
12:16I might as well just start [ __ ]
12:18learning D Vinci resolve properly and
12:20just completely cut the cord at this
12:22point okay because here's here's the
12:25thing about a company like Adobe it's
12:26one of those things it's like the
12:27Microsoft like recall stuff
12:30one company gets way too big and they
12:32pretty much dominate the market share
12:34and then they think they can get away
12:35with basically anything okay especially
12:36when they dabble into Fields like
12:38artificial intelligence you know I
12:40missed the days where you can just buy
12:42an actual like revision of a software
12:45and not have to worry about having a
12:47financial tie to a company right you
12:48used to be able to buy Adobe you know
12:51you could buy premier like CS5 CS6 and
12:54then they turned it into a subscription
12:56model right which basically you're you
12:58end up paying the same price roughly
13:00anyways but you just never own the
13:03software okay and they keep touting you
13:05with yes you get access to a consistent
13:07rolling release of software and updates
13:09and cool stuff behind the scenes but for
13:11most people who aren't really dabbling
13:13with the most experimental Tech they
13:16probably would be better if they could
13:17just buy a license and call it a day but
13:20at this moment in time if you're still
13:21using Adobe After reading [ __ ] like this
13:24it might be time for you to start
13:25cancelling your subscriptions I know
13:27that we are and we're probably just
13:28going to switch to is something that is
13:30a little less insulting to the
13:32intelligence of the average individual
13:34uh using their software that being said
