00:09Nintendo's software development team is
00:11awesome but Nintendo's legal team is
00:13terrifying I actually tried to name my
00:15firstborn son Luigi and immediately got
00:17served a seasoned assist so I had to
00:18name him snake instead today the Seal
00:20Team Six of legal teams has their sight
00:22set on an open source project called
00:24Yuzu it is February 28th 2024 and you're
00:27watching the code report people steal
00:29and re-upload my content all the time I
00:31could do something about it and make a
00:32Digital Millennium Copyright Act report
00:34but that would take an hour out of my
00:35day so instead I just bend over and take
00:37it Nintendo on the other hand will not
00:39be bent over they have a long history of
00:40defending their intellectual property
00:42rights through legal action back in
00:44the90s there used to be this thing
00:45called The Game Genie which allowed you
00:46to modify Nintendo games to cheat with
00:49things like invincibility the thing sold
00:50millions of units but Nintendo sued
00:52galoo toys arguing that they were
00:54violated because it modified their
00:56copyrighted Works Nintendo lost that
00:58lawsuit Mission failed we'll get them
01:00next time however Nintendo doesn't
01:02always lose if you have a Raspberry Pi
01:04laying around one thing you definitely
01:06shouldn't do is go to Retro p.org do.uk
01:09and download this tool that turns your
01:10Raspberry Pi into an arcade with
01:12emulators for NES Super Nintendo and
01:14Nintendo 64 retropie itself is not
01:16illegal but if you go to websites like
01:18emulator games.net you can download ROM
01:21images which are digital copies of video
01:23games these websit still exists but a
01:25few years back when Nintendo released
01:26its mini retro throwback console their
01:28legal team went after hosting websites
01:30and this one dude who is making 30k a
01:32year from ROM Universe has been ordered
01:34by the court to pay 2.1 million to
01:36Nintendo in Damages to be paid in $50
01:38monthly installments and the guy's
01:40already defaulted on the first payment
01:41Nintendo doesn't need the money but they
01:43want to ruin this guy's life to send a
01:45message that Nintendo will not be bent
01:46over and that brings us to 2024 and the
01:49Yuzu emulator lawsuit Yuzu is an open-
01:51Source Nintendo switch emulator that you
01:53can find on GitHub it's written in C++
01:55and allows you to run Nintendo switch
01:57games on Windows Linux and Android it
01:59current cently has 34,000 stars but be
02:02careful not to click this button because
02:03you might get sued Yuzu also has a
02:05patreon that's bringing in 30k a month
02:07that's a nice amount of money but
02:08they're going to need a lot more than
02:09that to fight their legal battle with
02:11Nintendo where they're accused of quote
02:13facilitating piracy at a colossal scale
02:15and because Yuzu is actually making
02:16money it helps justify Nintendo's case
02:18to go on the offensive let's take a look
02:20at how Yuzu works so you can decide
02:22who's in the wrong here first you go to
02:24yuu org to download the installer you
02:27then configure the settings for your
02:28hardware and now you're ready to start
02:29playing digital versions of Nintendo
02:31switch games well actually it's not
02:33quite that simple you'll also need a
02:34hackable Nintendo switch here's where
02:36the legal gray area comes in for some
02:38games to run you need to dump system
02:40files from a real Nintendo switch and in
02:42the documentation it explains how to do
02:44this by exploiting older switch consoles
02:46that are vulnerable to the Fus galet
02:48exploit which is a cold boot attack that
02:50exploits a flaw in the Nvidia Tegra X1
02:52processor used in the switch the exploit
02:54runs before the bootloader allowing you
02:56to change anything in the existing
02:58switch OS this allows hackers to run
03:00custom firmware and Homebrew
03:01applications on the switch and because
03:03it's on the processor itself Nintendo
03:04can't fix this with a simple software
03:06update and that means most units made
03:08before mid 2018 are vulnerable to this
03:10exploit now switch games are also
03:12encrypted to prevent piracy but Yuzu can
03:14dynamically decrypt them at runtime and
03:16Nintendo is arguing that that violates
03:18dmca which clearly states that you can't
03:20circumvent software protections what's
03:22interesting though is that the actual
03:24encryption keys don't come from Yuzu
03:26they need to come from the end user so
03:27technically Yuzu is not providing pirate
03:29games just the tools to actually run
03:31them and it's typically legal to reverse
03:33engineer something and emulate it as
03:35long as you're not breaking digital
03:36Rights Management there's another
03:37Nintendo emulator out there called
03:39dolphin that runs GameCube in Wii games
03:41it was going to be released on Steam but
03:43then they put the kabash on that after
03:44Nintendo filed a dmca complaint in that
03:47case though dolphin contained an AES 128
03:49encryption key used to encrypt wi games
03:51in its source code and that gave
03:52Nintendo a much stronger argument that
03:54dolphin was actively circumventing
03:56digital Rights Management Nintendo never
03:58actually sued dolphin though they only
03:59got them D platform from Steam with Yu
04:02though you need to bring your own Keys
04:03which makes Nintendo's case a lot weaker
04:05because again there's a lot of legal
04:06precedent that protects emulators it's
04:08illegal to Pirate software but that's
04:10not what Yuzu is doing it's merely
04:12giving you a gun with the emulator and
04:14teaching you how to make bullets in the
04:15quick start guide and really there's
04:16nothing wrong with that unless you use
04:18that information to go postal or God
04:19forbid pirate a Nintendo switch game
